Mark Emery
Employment and HR Partner

Mark became an employment lawyer shortly after qualifying over 20 years ago. Since then has worked with businesses and organisations, assisting from 'how to I conduct an investigation interview' to complex business sale and TUPE transfer issues. Mark's aim is to coach, to train HR teams and managers how to best resolve the issue. Mark assists in resolving employment related difficulties when they arise, aiming to resolve by settlement but if necessary defending claims in the employment tribunal. Mark also works with employees who have meritorious and high value claims. While based in Oxfordshire, Mark has a national client base of clients ranging from the cutting edge to the rural, including tech and bio-science companies, Oxford Colleges and Country Estates.

Mark sits as a 'fee-paid' Employment Judge at Central London Employment Tribunal for 30 days a year. This means he cannot assist on any employment tribunal claim at Central London ET.

Mark's recent work includes:

  • furlough advice and redundancies arising from Covid-19;
  • strike-related advice involving a large transport hub, including issues of police powers and lawfulness;
  • complex TUPE-related issue involving Tier 2 visa holders;
  • defending pregnancy-related discrimination claim;
  • defending claim against religious institution involving issues of child protection;
  • working with HR teams to resolve complex disputes with a high risk of litigation; and
  • working on global reorganisation for international charity involving world-wide redundancies.

Mark's work has been highlighted by his peers, who say:

He brings “passion to his work and a commitment to his clients”, who he makes “feel part of a winning team.” “Clients affirm their confidence in Mark Emery, who is praised for avoiding legalese and legal jargon”. “Interviewees note his prowess on contentious employment cases, praising him as a tenacious litigator – very clever and creative”.
