Johanna Smallman
Corporate and Commercial Disputes Partner

Johanna is a dispute resolution solicitor with over a decade of litigation experience. Johanna has worked for all sizes of construction and engineering companies representing them in contractual and tortious disputes. In addition, she has acted for manufacturers, on product liability claims, including defending a cross jurisdictional claim against the manufacturer of ice machines alleged to have caused a catastrophic fire.

Johanna has worked for clients who have had construction carried out which has been faulty such as extensions, glass installation and retaining walls.

Johanna has worked for almost every major insurer, advising and litigation in respect of policy disputes including issues surrounding breach of the duty of fair presentation and first party fraud. She has subsequently taken the benefit of this experience to advise policyholders who have had claims declined, taking them through the ombudsman process if appropriate.

She has resolved many disputes using alternative dispute resolution including mediation. Some of these settlements have involved complex contracts to be drafted, in order for the parties to achieve the resolution which they need to be able to move on from the dispute:

  • Defending a render manufacturer in a multi-million pound claim.
  • Pursuing a claim against an insurer following refusal to pay a claim for an electrical fire at a factory.
  • Recovering debt from a commercial electricity user where the issue in litigation was the existence of several meters at the premises and the accuracy of the measure of electricity actually used.
  • Assisting in pursuing several claims against a solicitor who allegedly negligently or fraudulently settled “injury at birth” claims over a number of years.
  • Assisting in cases involving negligent tax advice.
